Your activity on Borderless

The Site is intended for the exclusive purpose of aggregating literary content, identifying offerings, customising them, and then providing access to the same to subscribers, users and patrons of Borderless Journal, for their personal consumption and for domestic purposes and for no other purposes. Borderless Journal and its affiliates reserve the right to refuse service, terminate accounts, or remove or edit content in their sole discretion.

The Site shall not be used in any way that causes, or is likely to cause, the Site or access to it to be interrupted, damaged or impaired in any way.

If User submits material, and unless we indicate otherwise, User grants Borderless Journal and its affiliates a nonexclusive, royalty-free, irrevocable, perpetual and fully sub licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media for as long as you are permitted to grant the said licence under applicable law. Borderless Journal and its affiliates respect the intellectual property of others. If you believe that your work has been copied in a way that constitutes infringement of your intellectual property, please bring that to our notice, with valid supporting documents / evidences, for us to evaluate the claim, before taking such appropriate action as would be deemed expedient.

Borderless Journal and its affiliates attempt to be as accurate as possible, and take adequate precautions to avoid any mistakes, errors, and assure to positively attend to all such complaints, escalations on the mistakes, errors or omissions which may be brought to the notice of Borderless by the User. Further, Borderless does not warrant that descriptions of or other content of this Site is always accurate, complete, reliable, current, or error-free. Borderless may provide links to other sites over which Borderless Journal has no control. Borderless is not responsible for the availability of such external sites or resources and does not endorse and is not responsible or liable for any content, advertising, products or other material on or available from such sites or resources.

If you use the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. Once we are notified of the same, Borderless Journal will make all reasonable endeavours to remove such Objectionable Content complained about within a reasonable time.

Copyright, authors’ rights and database rights

All content included on the Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Borderless, its affiliates or its content suppliers and is protected by international copyright, authors’ rights and database right laws.

You may not systematically extract/ or re-utilise parts of the contents of the Site without Borderless Journal and / or its affiliate’s (as may be applicable) express written consent. In particular, you may not utilise any manual effort or data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this Site, without the express written content of Borderless Journal and/or its affiliate’s (as may be applicable)

Other Conditions

Please read these conditions carefully before using the Site. By using the Site, the User signifies his / her agreement to be bound by these conditions.

In addition, when the User uses any current or future Site service, the User will also be subject to the terms, guidelines and conditions applicable to that Borderless Service. (“Terms”).

Consent

Borderless Journal may invite submission for articles, stories, poems, and so forth (“Content”) from minors either directly or through its affiliate- Bookosmia. Such Content may be eligible for publication on Borderless’ s Site.

You consent as a parent and/or legal guardian to a minor for such submission of personal information of the minor including but not limited to name, personal details, school details and so forth being submitted in context to submission for such Content. You further consent that such content is subject to[nm6]  being edited and altered quantitatively and qualitatively to meet in-house requirements of Bookosmia, our partner for curating content from young authors (under 18 years of age).

Since these submissions are by a minor not competent to enter into contracts, ‘You’ shall mean the parent/guardian of the person submitting the story/essay/poem/any other literary work. When you submit your entry, you shall be deemed to have given Bookosmia an exclusive license to evaluate the it for publication. While Bookosmia shall make best efforts to come back to you with the result of their evaluation within 15 days from the date they receive your submission. In the event you do not get our reply within 21 days from the date of your submission, you may presume that they have decided not to publish the story. If Bookosmia and subsequently Borderless respond with a decision to publish your story, you shall be deemed to have assigned any and all copyright and other intellectual property rights in the story in favour of Bookosmia. The assignment shall be perpetual, irrevocable, worldwide and comprise all the copyright in the story. The assignment shall not revert to you under any circumstances. Without limitation, the assignment shall confer upon Booksomia and to make copies of, edit, adapt, translate and publish your story and to Borderless to republish the same. You shall be deemed to have waived your moral rights in the story. Both Bookosmia and Borderless shall always credit you as the author of the story. The opportunity provided to you to publish your work shall constitute sufficient consideration for the foregoing assignment.  You shall not disparage either Bookosmia or Borderless or its management, employees and other stakeholders in any manner whatsoever.

Losses

We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the Site.

Alteration of Service or Amendments to the Conditions

We reserve the right to make changes to our Site, policies, and these Terms of Use at any time. You will be subject to the policies and Conditions of Use in force at the time that you use the Site or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

Events beyond our reasonable control

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

Waiver
